Terms and Conditions of Use of the Portal www.regio4trip.eu

§1 General provisions

1. These terms and conditions of use set forth herein apply to the tourist portal located
   at www.regio4trip.pl, which is owned by the Local Action Group Association (LGD) Nad Białą Przemszą (hereinafter referred to as LGD Nad Białą Przemszą) having its registered office at: 32-310 Klucze, ul Partyzantów 1, entered into the National Court Register (KRS) under the number 0000294915. Acceptance of these terms and conditions constitutes a legal agreement between you and LGD Nad Białą Przemszą.
2. The portal was created within the project "Building a network of cooperation between the partners of the Olkusz district and foreign partners: the Batizovce commune,
   the Cserépfalu commune and the Ocland commune in the area of tourism development" (hereinafter referred to as the Project) co-financed by the European Union within the Małopolska Regional Operational Programme 2007-2013.
3. In these terms and conditions of use the following words and phrases have
   the following meaning:
   1. "Portal" – means the Web portal regio4trip.eu dedicated to tourism, administered by the Administrator.
   2. "Administrator" – the owner of the portal.
   3. "Foreign partners” – the Batizovce commune, the Cserépfalu commune and
      the Ocland commune, who are also partners in the project.
   4. "Project area” – the area of activity of LGD Nad Białą Przemszą and its foreign partners whose local tourist attractions are promoted on the site.
   5. "Partner” – means an accommodation or catering provider as well as other tourist service providers (e.g. equipment rentals, recreational services providers, etc.) in the area covered by the project, i.e. the region of activity of the Administrator and the Foreign partners
   6. "Institution” – is a business entity engaged in the promotion of tourism in
      the area covered by the project.
   7. "User" – means a natural or legal person that uses the Portal
4. The portal provides tourist offers in the area of activity of the Administrator and the Foreign partners i.e. offers regarding local tourist attractions and services – catering, accommodation, recreation facilities and others.
5. The presentations of tourist offers at a basic level are not charged a fee.

§2 Foreign partners

1. Foreign partners are registered by the Administrator.
2. Foreign partners are responsible for the content of the Portal i.e. tourist offers connected with local tourist attractions and services in their regions of activity.
3. Foreign partners may edit the content of the portal connected with their areas.
4. Administrator is not responsible for the content provided by the Foreign partners.

§3 Partners and Institutions

1. The Administrator is responsible for the acceptance of registration of a Partner or Institution.
2. Registration consists in completing the registration form.
3. By registering an account, the Partners or Institutions declare they have become familiar with these terms and conditions and undertake to strictly obey them.
4. Partners may add new content and edit the content already published within the scope of their activity i.e. description together with photo gallery.
5. Institutions may add new content and edit the content already published within
   the scope of their activity i.e. description together with photo gallery. Additionally, Institutions may add information on the Portal in the “news” tab.
6. For the purpose of editing and/or adding new content on the Portal, Partners and Institutions were registered by the Administrator and given access to cms.regio4trip.pl.
7. Partners and Institutions are fully responsible for the content published by them on
   the portal as well as its compliance with the law, in particular with regard to not infringing property copyright. The portal owner is not required to verify the material posted by Partners or Institutions, nor responsible for its content.
8. Partners and Institutions are obliged to constantly update the content, especially
   the availability of accommodation and information on the accommodation facilities offered.
9. Partners are fully responsible for contacts and completion of transactions with individuals who want to make a reservation through the online booking system for accommodation.
10. Partners and Institutions undertake to maintain the confidentiality of passwords and
    to do their utmost to prevent unauthorised access to the passwords.
11. Partner and Institution may provide their own web site address in the offer, but cannot publish the addresses of websites with similar activity as regio4trip.eu; these addresses will automatically be removed from the offers.
12. Partner and Institution is obliged to use the service in compliance with these terms and conditions.

§4 Administrator

1. The Administrator is responsible for moderation of the content posted on the forum and for the evaluation of accommodation facilities.
2. The Administrator is responsible for acceptance of registration of every Foreign partner, Partner and Institution.
3. The Administrator reserves the right to delete the content published by Foreign partner, Partner or Institution if it violates the terms and conditions of the portal or provides false information, violating the existing law or the principles of social coexistence.

§5 Privacy policy and copyright

1. The provision of personal data by the Partner or Institution is voluntary, yet, it must meet the requirements under the Act on the Protection of Personal Data. By entering the registration, Partner or Institution expresses consent to the collection, processing and use of personal data by the Administrator for the purpose of, and to the extent necessary to carry out activities promoting tourism in the Project area.
2. The provision of personal data by the User (in the reservation form of the online booking system for accommodation) is voluntary, but failing to provide the data will prevent the booking process. By making a reservation, the User expresses consent to the collection, processing and use of their personal data by the Administrator and Partners for the purpose of, and to the extent necessary to carry out activities promoting tourism in the Project area. 
3. The Administrator, Foreign partners, Partners and Institutions do not provide Users’ personal information to any persons, companies or other third parties.
4. The data will be processed in compliance with all safety requirements specified in
   the Act of August 29, 1997 for the Protection of Personal Data (Journal of Laws of 2002, No. 101, item 926 as amended) and its implementing rules.
5. Copying, dissemination of graphics, text, scripts and software without the consent of the Administrator is prohibited under the Act on Copyright and Related Rights of
   the 4th of February 1994.
6. It is forbidden to use the name of the Portal in such a way that it would mislead Users or otherwise have adverse effect on the image of the Portal.
7. All matters beyond the scope of the copyright require the consent of the Administrator of the Portal.

§6 Final provisions

1. The owner of the Portal is not liable for any losses or damages caused to the User by the following:
   1. lack of continuity of the Portal regio4trip.eu for non-culpable reasons
   2. false or incomplete information provided by the Foreign partners, Partners or Institutions
   3. force majeure
   4. an act of third parties using illegally obtained passwords of Foreign partners, Partners and Institutions, which is against these Terms and Conditions of Use.
2. Matters not regulated by the above Terms and Conditions of Use shall be governed by the provisions of the Civil Code and other applicable regulations in force in
   the Republic of Poland.
